Terms of Service

1. Acceptance of Terms

By creating an account, submitting a banner, purchasing a paid plan or placement, or otherwise using BannerLadder, you agree to these Terms and our Privacy Policy. If you use the service on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

2. Accounts and Access

• You are responsible for maintaining the security of your account, password, and any devices used to access the service.
• You must provide accurate registration and billing information and keep it current.
• You are responsible for all activity that occurs under your account, including banner submissions, payment actions, and public growth-page configuration.
• You may not share access in a way that bypasses your plan limits or interferes with platform security.

3. Acceptable Use

You may use BannerLadder only for lawful advertising and promotion. You may not upload, link to, or promote banners, landing pages, or destinations that:

• violate applicable law, regulations, or third-party rights;
• contain malware, phishing flows, harmful scripts, or deceptive redirects;
• promote fraud, impersonation, spam, or unauthorized data collection;
• contain illegal, abusive, hateful, violent, or otherwise harmful content; or
• attempt to manipulate clicks, impressions, leaderboard rank, or moderation outcomes through bots, low-quality traffic, or other abusive methods.

4. Banner Content and Destination Responsibility

• You are solely responsible for the content, claims, images, trademarks, URLs, and destinations associated with your banners.
• You must have all rights and permissions needed to use the creative assets and linked destinations you submit.
• You are responsible for ensuring that your landing pages, offers, and disclosures are accurate and legally compliant.
• BannerLadder may review, limit, pause, or remove banners that create legal, security, trust, or quality concerns.

5. Plans, Payments, and Upgrades

• Some features may require a paid plan, featured placement purchase, or other upgrade.
• Prices, billing terms, and plan limits are shown at checkout or in the pricing area in effect at the time of purchase.
• Unless stated otherwise, fees are non-refundable once a paid service, featured placement, or subscription period has begun.
• You authorize BannerLadder and its payment processors to charge the payment method you provide for subscriptions, one-time purchases, renewals, taxes, and related charges.
• If a payment fails or a charge is reversed, BannerLadder may suspend paid benefits, featured placements, or account access until the issue is resolved.

6. Moderation, Ranking, and Platform Operation

• BannerLadder may moderate submissions and set banners to pending review, approved and active, or rejected/inactive status.
• Leaderboard position, momentum score, click counting, impression counting, and placement are determined by the platform's live systems and anti-abuse controls.
• We may change platform settings, weighting, caps, or operational controls to preserve fairness, security, and service quality.
• We do not guarantee any minimum amount of traffic, impressions, clicks, ranking position, revenue, or business outcome.

7. Suspension and Termination

• You may stop using the service at any time.
• BannerLadder may suspend, restrict, or terminate access immediately if we reasonably believe you violated these Terms, created risk for users or the platform, failed to pay amounts due, or used the service abusively.
• We may remove banners, pause placements, or disable public pages while investigating security, fraud, legal, or policy issues.
• Sections that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and indemnity, survive termination.

8. Disclaimer of Warranties

BannerLadder is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and any guarantee that the service will be error-free, secure, or produce a specific marketing result.

9. Limitation of Liability

To the maximum extent permitted by law, BannerLadder and its operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid to BannerLadder in the 12 months before the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold harmless BannerLadder, its operators, and service providers from claims, damages, losses, liabilities, and expenses arising from your banners, destinations, account activity, misuse of the service, or violation of these Terms or applicable law.
